Contracts
As an employer the law states that you must provide your nanny with a contract/written statement of employment within 8 weeks of her starting with you. We recommend that you have this in place before your new nanny starts with you, so that everyone knows what is expected of them from the beginning. When we place a nanny with you we will automatically send you our sample contract for you to use if you so wish and advise you on how best to adapt it to your specific requirements.
Insurance
It is advisable that you take out Employers Liability Insurance to protect yourself if your nanny has an accident in the home during her working day. Many household insurance providers can add this to existing policies but you need to check with your provider. If your nanny is going to be driving the children in your car you must make sure she is covered on your policy. If she will be using her own car she must take out business insurance, this can usually be added to her normal policy for a small cost.
Holiday Entitlement
All nannies are entitled to holiday pay. It is usual for the family and the nanny to choose half the holiday entitlement each. Please see chart below for holiday entitlement.
All employees are entitled to 5.6 weeks holiday from 1st April 2009
i.e. Employees' that work;
1 day get 5.6 days holiday per year
2 days get 11.2 days holiday per year
3 days get 16.8 days holiday per year
4 days get 22.4 days holiday per year
5 days get 28 day holiday per year.
Whether or not this additional leave is taken on a Bank Holiday is up to individual employers to agree with their workers. Employers may choose to offer more holiday than this.
What Other Costs Could There Be?
The main other cost to take into consideration is a petrol allowance. It is expected that the family will pay an allowance for miles done during the working day. HM Revenue and Customs currently recommend this is 40p per mile for the first 10,000 and then 25p per mile after that.
It is also normal for the family to leave a float for the nanny to use during the working week with clear guidelines in place with regard to what it can be spent on. The nanny should keep receipts to account for all monies spent.
